The Life of Elreta Melton Alexander

This book explores the life and contributions of attorney, Elreta Melton Alexander Ralston (1919-1998). In 1945, Alexander became the first African-American woman to graduate from Columbia Law School. In 1947, she was the first African-American woman to practice law in the state of North Carolina, and subsequently, in 1968, became the first African-American woman to become an elected district court judge. Despite her accomplishments, Alexander is little known to scholars outside of her hometown of Greensboro, North Carolina. Her life and career deserve recognition, however, not just because of her impressive lists of 'firsts,' but because she accomplished such impressive feats in the midst of the civil rights movement in the U.S. South. While Alexander did not actively participate in civil rights marches and demonstrations, she used her professional achievements and middle-class status to advocate for individuals who lacked a voice in the southern legal system. This book argues that Alexander was integral to the civil rights movement in North Carolina. Women like Alexander worked to change discriminatory laws while opening professional doors for other minority women. Women and African Americans have historically used the law as a means of obtaining personal and societal change, which was vital during the civil rights movement. Using her professional status, Alexander combated segregation by demonstrating that black women were worthy and capable of achieving careers alongside white men, thereby creating environments in which other African Americans could succeed. Her legal expertise and ability to reach across racial boundaries made her an important figure in Greensboro, North Carolina history

Sexual Assault on Campus: Defending Due Process

The Hunting Ground recounts the story of Erica Kinsman.1 On December 7, 2012, Erica, then a freshman at Florida State University (FSU), reported to campus police that she had been raped by an unknown male. Erica was transported to the hospital where her injuries were photographed, and samples were taken to test for the presence of semen. One month later, Erica told the investigating officer that she recognized the man who raped her from one of her classes. His name: FSU football sensation and future Heisman Trophy winner, Jameis Winston. Despite the identification, it took eleven months for Jameis' DNA to be tested and compared with the semen found on Erica's underwear. In the meanwhile, the FSU police secured a copy of the Tallahassee report, which they gave to administrators in the Athletic Department, who then turned it over to Jameis' lawyer

Death by Prison

In recent decades, life imprisonment without the possibility of parole (LWOP) has developed into a distinctive penal form in the United States, one firmly entrenched in US policy-making, judicial and prosecutorial decision-making, correctional practice, and public discourse. LWOP is now a routine part of contemporary US criminal justice, even engrained in the nation's cultural imaginary, but how it came to be so remains in question. Fifty years ago, imprisoning a person until death was an extraordinary sentence; today, it accounts for an increasing percentage of all US prisoners. What explains the shifts in penal practice and the social imagination by which we have become accustomed to imprisoning individuals until death without any reevaluation or reasonable expectation of release? Combining a wide historical lens with detailed state- and institutional-level research, Death by Prison offers a provocative new foundation for questioning this deeply problematic practice that has escaped close scrutiny for too long. The rise of life without parole, this book demonstrates, is not simply a matter of growth: it is a phenomenon of change, inclusive of changes in definitions, practices, and meanings. Death by Prison shows that the complex processes by which life without parole became imprisonment until death and perpetual confinement became a routine part of American punishment must be understood not only in terms of punitive attitudes and political efforts but as a matter of background conditions and transformations in penal institutions. The book also reveals how the social and sociological relevance of life without parole extends beyond its punitive element: imbued in the history of life without parole are a variety of forms of disregard--for human dignity, for social consequences, and for the myriad responsibilities that go along with state punishment

Entry Lessons

Through oral histories, interviews, embedded observation, and research, the daily struggles of women returning to life after incarceration and concrete solutions to the seemingly hopeless issue. At the end of 2019 in the United States, women comprised the fastest growing population within the criminal justice system. Despite this fact, their journey through this system has not received extensive attention; it is only beginning to be documented. As a result, the impact of women's incarceration and reentry--both on their own lives and in the lives of their children and their families--is neither well understood nor effectively confronted. Anthropologist Jorja Leap argues that all aspects of these women's journey must be illuminated to fully grasp the issues. Leap explores first the traumas girls and women suffer, then the particular challenges faced by women in the criminal justice system, in incarceration, and throughout the reentry process. Leap tells the stories of women who suffer childhood abuse and neglect, including for example, Clara, who suffered twice--once as a child within the welfare system and then as a mother whose children were removed from her care and placed within the system--highlighting the ways the system fails women in particular. She finds that the lack of reentry programs is directly related to rates of recidivism, concluding that the cycle of trauma is the embedded in the system of reentry. Having spent countless hours embedded in the reentry programs that do currently exist, including Susan Burton's A New Way of Life, Leap tells the dramatic stories of many women caught in the system. She closes with several future-facing chapters. The experiences of formerly incarcerated women must be translated into lasting structural change through the development of meaningful programs and policies. Leap delves into pilot programs that offer meaningful models for changing the cycles of abuse and trauma in the lives of women.

The Imagined Juror

It is the figure and role of 'make-believe' or 'imagined' juror in the professional lives of prosecutors that is the subject of this book. Drawing on an extended ethnographic study of federal prosecutors, it explores this paradoxical feature of the federal legal landscape: though laypeople only infrequently participate in federal trials, make-believe jurors have an outsized presence in the decision-making and professional imagination of some of our most powerful legal actors. In their imagined jurors, prosecutors discover a critical resource for making sense of their ill-defined directives to seek justice and represent the United States. They also find a means of thinking of discussing mercy, acknowledging evolving community mores, and discovering themselves as moral actors rather than line attorneys carrying out supervisors' directives. Even in a period of infrequent jury trials, this book shows, the very existence of the jury system-and the possibility of facing a jury-use their discretion with reference to views of others. At the same time, it highlights the limitation of legal system where jurors are primarily imaginary, calling for reforms that would foster a more inclusive and effective American jury

Legal Spectatorship examines the visual culture surrounding domestic violence, or DV, focusing on the ways that photographs are marshaled as a form of spectacular evidence rooted in slavery and antiblackness. Historically, slaves were not able to testify in person in court although they were often silent witnesses to white domestic conflicts. Today, these histories of racism are embedded into domestic violence prosecution as photographs documenting evidence of DV stand in for women's testimony, and an extensive web of surveillance and administrative tactics criminalize female victims. Kelli Moore reads the legislative, juridical, and media structures that have developed around domestic violence as an extension of the logics of slavery that points to a broader form of US "domestic violence" in the form of slavery and racism. The chapters take up slave witnessing and black subjectivity; the psychological theories that developed around DV in the context of the Civil Rights movement; "artivism" around domestic violence imagery and anti-DV campaigns; and Moore's own ethnographic work in the courtroom observing domestic violence cases.

Neighborhood Watch

This book explores the private weaponization of racial fear that drives modern-day enforcement of these Black and White spaces. More than any express hatred of African Americans or desire to return to formal segregation, private White actors today react to deeply ingrained, systemic, and often unconscious racial fear of Black people who appear "out of place" in their public environment. They weaponize this racial fear in a variety of ways, including by abusing 911 to enforce formal social control via armed government agents, by trafficking in racial fear to whitewash their own misdeeds through "racial hoaxes," and by exacting vigilante justice through extrajudicial killing under the guise of self-defense and standing one's ground. Each of these approaches perverts and exploits the weapon of choice - the criminal justice system - with violent repercussions for the Black targets of this subformal apartheid. More often than not, private actors employing these methods enjoy the express or implicit support of government officials at all levels, from local police departments to state legislatures to the United States Supreme Court.

Pioneering Eeath : The Violence of Boyhood in Turn-of-the-Century Oregon

In rural Oregon in 1895, an 18-year-old youth named Loyd Montgomery murdered his parents and a visiting neighbor and was then tried and executed for the crime. Placing these killings within the broader context of the agrarian crisis and the demise of the Oregon pioneer generation, Boag illuminates not only why the parricide happened but also the effects it had on the community and society wherein it occurred. More than a local history, this project examines larger issues of regional and U.S. history of the era: boyhood in the late 19th century, the economic and political woes of farmers in Oregon and the Northwest in the face of globalization and industrialization, and challenges to the cultural and social ideals of rural Oregon and the U.S. in general. Boag also critically examines the ways in which white community members integrated the murders into their local histories to construct narratives of peace, progress, and justice in order to preserve the idyllic myth of the Pacific Northwest at the turn of the century

Prisons of Debt

A profound portrait of the hidden injustices that trap fathers in a cycle of punishment and debt. In the first study of its kind, sociologist Lynne Haney travels into state institutions across the country to document the experiences of the millions of fathers cycling through the criminal justice and child support systems. Prisons of Debt shows how these systems work together to create complex entanglements-rather than "piling up" in men's lives, these entanglements form feedback loops of disadvantage. The prison-child support pipeline flows in both directions, deepening parents' debt and criminal justice involvement. Through moving accounts of men struggling to be fathers from behind prison walls and under the weight of support debt, Prisons of Debt exposes how the criminalization of child support undermines the most essential of familial relationships. Haney argues that these state systems can end up producing exactly the kind of parent they fear and loathe: bitter, unreliable, and cyclical fathers. Based on observations of 1,200 child support cases and interviews with 145 indebted fathers in New York, California, and Florida, Prisons of Debt reveals the actual practices of child support adjudication and enforcement alongside the lived realities of fathers trapped in those systems. Progressive Prosecution

The 2020 murder of George Floyd rocked nearly every aspect of American life and brought issues of police brutality to the forefront of public discourse. In the wake of his death and under extreme public pressure, many politicians, police chiefs, and court officials acknowledged the existence of systemic inequality in the fields of policing and criminal justice. However, with few exceptions, one actor within the justice system remained painfully silent: prosecutors. Progressive Prosecution both argues that this group should be at the forefront of calls for criminal justice reform and provides a guidebook for how this can be achieved. Shattered Justice

Shattered Justice presents original crime victims' experiences with violent crime, investigations and trials, and later exonerations in their cases. Using in-depth interviews with 21 crime victims across the United States, Cook reveals how homicide victims' family members and rape survivors describe the painful impact of the primary trauma, the secondary trauma of the investigations and trials, and then the tertiary trauma associated with wrongful convictions and exonerations. Important lessons and analyses are shared related to grief and loss, and healing and repair. Using restorative justice practices to develop and deliver healing retreats for survivors also expands the practice of restorative justice. Finally, policy reforms aimed at preventing, mitigating, and repairing the harms of wrongful convictions is covered.

In this book, the authors explore the many ways that menstruation makes a difference in law and life in the United States. The book looks at cultural attitudes toward menstruation, the tampon tax, the need for accessible products in schools, prisons, and other public buildings, employment discrimination matters, health and environmental concerns, the complex market for menstrual products, and the ways similar issues at the intersection of menstruation and law arise in other countries. This book asks what the law currently says about menstruation (spoiler alert: not much, at least not explicitly) and lays out concrete suggestions for legal reform. The authors aim to transform the law and society so that every person can participate fully in all aspects of public and private life, without regard to the involuntary biological process of menstruation.

Phyllis Frye and the Fight for Transgender Rights

The first openly transgender judge to be appointed in the United States, the first attorney to obtain corrected birth certificates for transgender people who had not undergone gender confirmation surgery, a survivor of conversion therapy, and author of a law review article that helped thousands of employers adopt supportive policies for their workers, Phyllis Frye is truly a pioneer in the fight for transgender rights. Among her many accomplishments, Frye founded the first national organization devoted to shaping transgender law-the International Conference on Transgender Law and Employment Policy, which has since created a body of work that includes the International Bill of Gender Rights-trained a cadre of future trans activists, and built the first national movement for transgender legal and political rights. Based on interviews with Frye, Phyllis Frye and the Fight for Transgender Rights covers her early life, the discrimination she faced while struggling with her identity-including being discharged from the army and fired from a subsequent job at her alma mater, Texas A&M-her transition in 1976, her many years of activism, and her current position as an associate judge for the municipal courts of Houston. Vigilantes Beyond Borders

Nongovernmental organizations (NGOs) have generally served as advocates and service providers, leaving enforcement to states. Now, NGOs are increasingly acting as private police, prosecutors, and intelligence agencies in enforcing international law. NGOs today can be found investigating and gathering evidence; suing and prosecuting governments, companies, and individuals; and even catching lawbreakers red-handed. Examining this trend, Vigilantes beyond Borders considers why some transnational groups have opted to become enforcers of international law regarding such issues as human rights, the environment, and corruption, while others have not. Three factors explain the rise of vigilante enforcement: demand, supply, and competition. Governments commit to more international laws, but do a poor job of policing them, leaving a gap and creating demand. Legal and technological changes make it easier for nonstate actors to supply enforcement, as in the instances of NGOs that have standing to use domestic and international courts, or smaller NGOs that employ satellite imagery, big data analysis, and forensic computing. As the growing number of NGOs vie for limited funding and media attention, smaller, more marginal, groups often adopt radical strategies like enforcement. The International Legal Protection of Environmental Refugees

Climate change and other forms of environmental degradation, such as earthquakes and soil erosion, in combination with other factors (such as poverty, lack of government action and armed conflict) can lead to forced migration. The protection of these environmental refugees requires a different approach than that of 'traditional war refugees'. Most environmental refugees are internally displaced. As a result, developing countries that are hit hardest by the negative effects of climate change, also have to deal with high numbers of internally displaced persons. These countries rely on international support to be able to bear the costs of mitigation- and adaptation measures. The current legal system not only offers insufficient protection for environmental refugees, but also offers insufficient opportunities for support by the international community. Principles and rules of international environmental law, human rights law and State responsibility can be used in an instrumental way to co-finance and support local measures. This thesis argues for the combination of a human rights-based, security and State responsibility approach to create medium and long-term protection regimes for environmental refugees that makes use of the possibilities to prevent migration or, if inevitably, manage migration

Legal Spectatorship

Legal Spectatorship examines the visual culture surrounding domestic violence, or DV, focusing on the ways that photographs are marshaled as a form of spectacular evidence rooted in slavery and antiblackness. Historically, slaves were not able to testify in person in court although they were often silent witnesses to white domestic conflicts. Today, these histories of racism are embedded into domestic violence prosecution as photographs documenting evidence of DV stand in for women's testimony, and an extensive web of surveillance and administrative tactics criminalize female victims. Kelli Moore reads the legislative, juridical, and media structures that have developed around domestic violence as an extension of the logics of slavery that points to a broader form of US "domestic violence" in the form of slavery and racism. The chapters take up slave witnessing and black subjectivity; the psychological theories that developed around DV in the context of the Civil Rights movement; "artivism" around domestic violence imagery and anti-DV campaigns; and Moore's own ethnographic work in the courtroom observing domestic violence cases.

The Life of Elreta Melton Alexander

This book explores the life and contributions of attorney, Elreta Melton Alexander Ralston (1919-1998). In 1945, Alexander became the first African-American woman to graduate from Columbia Law School. In 1947, she was the first African-American woman to practice law in the state of North Carolina, and subsequently, in 1968, became the first African-American woman to become an elected district court judge. Despite her accomplishments, Alexander is little known to scholars outside of her hometown of Greensboro, North Carolina. Her life and career deserve recognition, however, not just because of her impressive lists of 'firsts,' but because she accomplished such impressive feats in the midst of the civil rights movement in the U.S. South. While Alexander did not actively participate in civil rights marches and demonstrations, she used her professional achievements and middle-class status to advocate for individuals who lacked a voice in the southern legal system. This book argues that Alexander was integral to the civil rights movement in North Carolina. Women like Alexander worked to change discriminatory laws while opening professional doors for other minority women. Women and African Americans have historically used the law as a means of obtaining personal and societal change, which was vital during the civil rights movement. Using her professional status, Alexander combated segregation by demonstrating that black women were worthy and capable of achieving careers alongside white men, thereby creating environments in which other African Americans could succeed. Her legal expertise and ability to reach across racial boundaries made her an important figure in Greensboro, North Carolina history
