Global Animal Law from the Margins

This book critically engages the emerging field of global animal law from the perspective of an intersectional ethical framework. Reconceptualising global animal law, this book argues that global animal law overrepresents views from the west as it does not sufficiently engage views from the Global South, as well as from Indigenous and other marginalised communities. Tracing this imbalance to the early development of animal law's reaction to issues of international trade, the book elicits the anthropocentrism and colonialism that underpin this bias. In response, the book outlines a new, intersectional, second wave of animal ethics. Incorporating marginalised viewpoints, it elevates the field beyond the dominant concern with animal welfare and rights. Gender, Vulnerability Theory and Public Procurement

Taking up the concept of vulnerability, this book examines the gendered impact of market-based procurement practices. In recent years, ideological shifts and real managerial constraints have forced states everywhere to rely on private resources to solve public problems. Focusing on instances where the state retains ownership of assets and rights, even if it temporarily devolves its authority to a private entity (profit or non-profit), this book uncovers the ways in which these private actors are not just suppliers of materials goods, but increasingly policy influencers. The Incarceration of Native American Women

Colonization and the historical trauma of Native American incarceration runs through history, spanning multiple generations and including colonial wartime imprisonment, captivity, Indian removal, and boarding schools. The ongoing ills of childhood abuse, domestic violence, sexual assault, and drug and alcohol addiction and the rising number of suicides are indicators that Native people need healing. Based on her research and work with Native women in prisons, Corcoran provides a theory of wellness and recovery that creates a pathway for meaningful change. Rape, Agency, and Carceral Solutions: From Criminal Justice to Social Justice

News media and popular culture in the United States have produced a conventional narrative of the outcomes of sexual abuse: someone perpetrates sexual violence, goes to trial, and is then punished with prison time. Survivors recede into the background, becoming minor characters in their own stories as intrepid prosecutors, police officers, and investigators gather evidence and build a case. Leland G. Spencer explains how the stories we tell about sexual assault serve to reinforce rape culture, privileging criminal punishment over social justice and community-based responses to sexual violence. Examining a broad range of popular media, including news coverage of the Brock Turner case, Naomi Iizuka's popular play Good Kids, the television program Criminal Minds, and the book turned television show 13 Reasons Why, Spencer demonstrates how these representations shore up the carceral state, perpetuate rape myths, blame victims, and excuse those who harm. The Swine Republic: Struggles with the Truth about Agriculture and Water Quality

Interested in the truth about Iowa's water quality? You won't get it from Iowa's agricultural and political leaders. Among midwestern Corn Belt states, Iowa contains some of the world's most productive farmland; the state frequently tops all others in harvested totals of corn and soybeans and has helped the U.S. be the world's largest producer of corn every year since at least 1961. Iowa also has a lot of animals that eat corn and soybeans. The state is first in egg and pork production and fifth in the number of feedlot cattle. Concentrating both cropland and livestock within the state has created efficiencies in production, transportation, fertilization, and accumulated wealth for a lucky few. The immensity of this production has come at a cost: soil erosion, the loss of wildlife habitat, a lack of public parks and recreation areas, foul air from animal waste, and especially degraded water. Iowa has over 70,000 miles of streams, and only 15 segments of these meet all the designated uses outlined under the Clean Water Act. The pollutants from Iowa's rivers ultimately drain to the Mississippi River and the Gulf of Mexico, part of which is killed off every summer by Corn Belt pollution from farms 1,500 miles upstream. More than 20% of Iowans drink water treated for the removal of nitrate -- a regulated drinking water contaminant that results from corn and livestock production -- and nearly 7,000 private wells are contaminated with this pollutant. Yet the state's elected leaders and the Big Ag industry (in some cases one and the same) continue to whistle past the graveyard on their way to parking their backsides on the status quo, all the while gaslighting citizens about the condition of their water. In The Swine Republic, Chris Jones takes a long hard look at the science, politics, culture, and economics of Iowa agriculture and the state's degraded waters and connects the dots for everyone who wonders why progress toward improvement is so maddeningly slow in Iowa and the rest of the farmed Midwest.

The International Criminal Court (ICC), created in 2002 to combat impunity, projects a sense of unfairness and stirs an unending debate. A trial before the court epitomizes the controversy surrounding it, perceived as a neocolonialist tool in the hands of the most powerful nations. This research critically examines the trial of the former president of Ivory Coast, Laurent Gbagbo. The two-decade crisis in Ivory Coast was a series of armed, diplomatic, and political conflicts in which human rights were violated by all sides. Military confrontation resumed as a result of an electoral stalemate that followed a controversial presidential election in the fall of 2010. The most atrocious human rights abuse was perpetrated at the end of March 2011 by the rebel forces backed by the French and the United Nations troops: the massacre of Duékoué. In one day, hundreds of Laurent Gbagbo's followers were killed. However, the ICC undertook a selective prosecution against Gbagbo's camp. After a trial of eight years, Laurent Gbagbo was finally acquitted. The news of his unanticipated acquittal shocked the world. Later, that decision was overturned and transformed into freedom with binding and coercive conditions by the Appeals Chamber, which had succumbed to political pressure. The former president of Ivory Coast spent months of confinement in Belgium until the Appeals Chamber rebutted the prosecutor's appeal against his release and confirmed his total acquittal and that of Blé Goudé. He eventually went back to Ivory Coast on June 17, 2021. The trial of Laurent Gbagbo before the ICC, despite his acquittal (a tardy one), reflects a series of biases germane to international law and international justice, such as the victor's justice stance, the conflict between national law and international law, the question of sovereignty, and the issue of lawfare. The trial of Laurent Gbagbo, which was the hallmark of the selective international justice system embedded in unfairness, led to a historical landmark with his shocking acquittal, which led to the indictment of the International Court, whose fate has thus been sealed before history.

Between the twelfth and thirteenth centuries, custom went from being a largely oral and performed practice to one that was also conceptualized in writing. Based on French lawbooks known as coutumiers, Ada Maria Kuskowski traces the repercussions this transformation - in the form of custom from unwritten to written and in the language of law from elite Latin to common vernacular - had on the cultural world of law.
