In his infamous opinion in Dred Scott v. Sandford (1857) Chief Justice Taney had denied that any American descended from Africans, whether free or slave, could claim citizenship. The Fourteenth Amendment's citizenship clause repudiated this principle. The Fourteenth Amendment's connection to birthright citizenship, however, is not built exclusively through the lives and fortunes of black citizens. It requires an understanding of the Chinese experience of migration to the United States, and Wong Kim Ark v. United States (1898) lies at the center of this story.

Insurrection

The Insurrection Act of 1807 (passed amid pervasive fears of slave rebellions) authorizes the president to deploy federal troops to quell domestic uprisings. Invoked during Reconstruction and the civil rights movement, the Act was deployed to enforce the promise of equal citizenship for Black Americans. But the Act has also authorized federal military intervention to suppress so-called race riots after Martin Luther King Jr.'s assassination and during the 1992 Los Angeles rebellion; more recently, President Trump threatened to use the Act in response to the George Floyd racial justice protests. Hawa Allan argues that the invocation of the Act to either enforce civil rights or suppress riots reflects the enduring struggle to incorporate Black Americans as full citizens of the United States. The Right to Bear Arms

The Rule of Law in the United States: An Unfinished Project of Black Liberation

What is the American rule of law? Is it a paradigm case of the strong constitutionalism concept of the rule of law or has it fallen short of its rule of law ambitions? This book traces the promise and paradox of the American rule of law in three interwoven ways. It focuses on explicating the ideals of the American rule of law by asking: how do we interpret its history and the goals of its constitutional framers to see the rule of law ambitions its foundational institutions express? It considers those constitutional institutions as inextricable from the problem of race in the United States and the tensions between the rule of law as a protector of property rights and the rule of law as a restricter on arbitrary power and a guarantor of legal equality. In that context, it explores the distinctive role of Black liberation movements in developing the American rule of law. Finally, it considers the extent to which the American rule of law is compromised at its frontiers, and the extent that those compromises undermine legal protections Americans enjoy in the interior. It asks how America reflects the legal contradictions of capitalism and empire outside its borders, and the impact of those contradictions on its external goal.

Western Water Rights and the U. S. Supreme Court

Exploring the little-known history behind the legal doctrine of prior appropriation 'first in time is first in right' used to apportion water resources in the western United States, this book focuses on the important case of Wyoming v. Colorado (1922). U.S. Supreme Court Associate Justice Willis Van Devanter, a former Chief Justice of Wyoming, ruled in that state's favor, finding that prior appropriation applied across state lines a controversial opinion influenced by cronyism. Tribal Sovereignty in Alaska is the first comprehensive history of the Alaska Native tribal sovereignty movement. In 1932, Secretary of the Interior Ray Lyman Wilbur explained that "the United States has had no treaty relations with any of the aborigines of Alaska nor have they been recognized as the independent tribes with a government of their own." As a continuation of that policy, in 1971 when Congress settled Alaska Native land claims by enacting the Alaska Native Claims Settlement Act, at the request of Native leaders, it required Alaska Natives to incorporate business corporations under the laws of the State of Alaska that then were conveyed land in fee title. But today the Secretary of the Interior and those same Native leaders are adamant that there are more than 200 federally-recognized tribes in Alaska whose members are "sovereign" and whose governing bodies possess "inherent" governmental authority. What is the American rule of law? Is it a paradigm case of the strong constitutionalism concept of the rule of law or has it fallen short of its rule of law ambitions? This book traces the promise and paradox of the American rule of law in three interwoven ways. It focuses on explicating the ideals of the American rule of law by asking: how do we interpret its history and the goals of its constitutional framers to see the rule of law ambitions its foundational institutions express? It considers those constitutional institutions as inextricable from the problem of race in the United States and the tensions between the rule of law as a protector of property rights and the rule of law as a restricter on arbitrary power and a guarantor of legal equality. In that context, it explores the distinctive role of Black liberation movements in developing the American rule of law. Finally, it considers the extent to which the American rule of law is compromised at its frontiers, and the extent that those compromises undermine legal protections Americans enjoy in the interior.
