Vaccine Law: A Legal Research Guide

Vaccine law has been a subject of interest in the United States since the introduction of the process of vaccination for smallpox in the 1890s. Indeed, the first federal public health law ever enacted in the country was an 1813 measure to promote vaccination through providing a supply of vaccine matter. In the intervening decades, vaccine law has given rise to numerous statutory, regulatory, and common law structures revolving around the broad public policy interest in having a society that is, to the greatest extent possible, protected against infectious disease. The field of vaccine law therefore encompasses the regulatory environment for the development and licensure of vaccines; market regulations including intellectual property protections; public health measures including vaccination mandates, and their various required exemptions and accommodations; legal responses to adverse reactions; and efforts to promote public confidence in vaccines, and to combat misinformation. In response to the ever-evolving state of vaccine law and its legal complexities, the authors have put together critical references in one resource, including federal and state statutes and regulations, encyclopedias, legal and scientific articles, and practice books. With an audience of professionals in the legal system and public health in mind, it is the sincere hope of the authors that the references presented in this bibliography are used to promote understanding of vaccine law.
