Jailhouse Informants

Resisting Garbage
by
Lily Pollans's Resisting Garbage presents a new theory for understanding practices of waste removal and recycling in American cities, one that is grounded in the close observation of case studies but broadly applicable to many American cities today. The first part of the manuscript delineates the contours of current waste practices, and in particular the evolution of what Pollans calls the "weak recycling waste regime" of the United States. This "regime," which currently dominates American cities, "prioritizes hygiene, sanitation, and efficiency," is defined by unregulated consumption and production, and "allows limited post-consumer recycling of a few materials as a way to quell consumers' environmental anxiety." The second part of the study looks closely at the waste management stories of Seattle and Boston over the last forty years. As Pollans shows, these two cities began at around the same place in the 1980s, but followed radically different paths.

Can Blockchain Solve the Hold-Up Problem in Contracts?

A vexing problem in contract law is modification. Two parties sign a contract but before they fully perform, they modify the contract. Should courts enforce the modified agreement? A private remedy is for the parties to write a contract that is robust to hold-up or that makes the facts relevant to modification verifiable. Provisions accomplishing these ends are renegotiation-design and revelation mechanisms. But implementing them requires commitment power. Conventional contract technologies to ensure commitment - liquidated damages - are disfavored by courts and themselves subject to renegotiation. Smart contracts written on blockchain ledgers offer a solution. We explain the basic economics and legal relevance of these technologies, and we argue that they can implement liquidated damages without courts.

The 1948 Universal Declaration of Human Rights (UDHR) is one of the most important and debated sociopolitical documents of the twentieth century. A leading authority on the UDHR, Johannes Morsink is the author of The Universal Declaration of Human Rights: Origins, Drafting, and Intent (2000) and Inherent Human Rights: Philosophical Roots of the Universal Declaration (2009). This book is the first of its kind to discuss doping within Non-Olympic Sports. Sports like American football, cricket and dance sports have, in recent years, been in the news for doping activities. The scale of the incidents may differ in each of these sports, but they present interesting questions about the legitimacy of the World Anti-Doping Agency (WADA) Code. This book argues against the International Olympic Committee (IOC)-run regime where WADA Code compliance is used as the only parameter to define an activity as a sport. The book argues that the definition of modern sport is based on certain factors identified through sociological and historical research. These parameters are common across the board and do not distinguish between Olympic and Non-Olympic sports. However, the use of the word Olympic in the Non-Olympic sport terminology subjects such sports to IOC dictates. Consequently, the IOC exploits its monopoly over the word Olympics to insist on WADA Code compliances.
