Automated Agencies is the definitive account of how automation is transforming government explanations of the law to the public. Joshua D. Analyzing provincial statutes and hundreds of criminal prosecutions, Kristin A. Olbertson argues that colonists transformed their understanding of speech offenses, from fundamentally ungodly to primarily impolite. As white male gentility emerged as the pre-eminent model of authority, records of criminal prosecution and punishment show a distinct cadre of politely pious men defining themselves largely in contrast to the vulgar, the impious, and the unmanly. "Law," as manifested in statutes as well as in local courts and communities, promoted and legitimized a particular, polite vision of the king's peace and helped effectuate the British Empire. Rehabilitating Criminal Justice

Rehabilitating Criminal Justice offers bold yet sensible proposals for reforming every major component of the US criminal justice system. The first third of the book explains how existing caselaw can be interpreted to end over-policing, better regulate interrogations, and replace the exclusionary rule with direct sanctions on officers and their departments. Branching Out: The Public History of Trees

Trees are not just natural resources; they are also cultural ones that present unique challenges and opportunities for public historians. Trees can serve as important objects of memory, recalling past triumphs or tragedies. They can be the last living witness to important events or community stories. Trees can also be objects of preservation, sometimes as individuals, other times as stands or even forests, all of which can take on historical significance for people, sites, and institutions. But as living entities they defy the kind of permanent legal preservation applicable to buildings and other non-living historical objects. Furthermore, their organic fragility can actually make them significant problems for historical sites and local preservation activities. For example, communities have had to cope with extensive tree loss from storm and fire damage, and dying trees can drop limbs or topple over, creating considerable danger to people and resources. Climate-change-driven increasing storm intensity has also highlighted the ways that trees--however historical or beloved--can become considerable threats. The fourteen new essays in this volume explore the many ways that trees are an integral part of public history practice and sites. The authors draw on a range of approaches and historiographies to look at how memories of race-based hate, patriotic stories, community identities, and changed places have all centered on trees. Peyote Politics: The Making of the Native American Church, 1880-1937

Regarding peyote use among Native Americans, an ethnologist noted in 1891: "The ceremonial eating of the plant has become the great religious rite of all tribes of the southern plains." But, as Lisa D. Barnett observes in Peyote Politics: The Making of the Native American Church, 1880-1937, Peyotism quickly came under scrutiny, with opponents, both non-Native and Native, seeking to prohibit the religious practice by transforming peyote into a narcotic, thereby drawing Indigenous people into the emerging racialized campaign against drugs. A history of the rise of Peyotism and the Native American Church from the 1880s to the 1930s, Barnett's work details the ensuing struggle and its significance in reshaping Peyotists' identity as "Native" and "American" and establishing their place in the American political and legal systems. Barnett describes the strategies of resistance that Peyotists employed against opponents of their religious practice, including incorporating in 1918 as the Native American Church. In doing so, they secured their religious freedom but also formed a new, hybrid cultural sense of "Native American" that emphasized the reality of honoring both Native identity and American identity on the path to citizenship status. Placing the story of Peyotism within the broader historical context of federal Indian policy and Progressive Era politics, Peyote Politics shows how, despite their minority status in the American religious landscape, Peyotists were determined to secure constitutional protections for their religion and its rituals. Through their tireless efforts to protect their religion within the legal and political system, these Native Americans, many of whom were not yet American citizens, proved to be the true proponents of the constitutional idea of religious freedom.

Branching Out: The Public History of Trees

Trees are not just natural resources; they are also cultural ones that present unique challenges and opportunities for public historians. Trees can serve as important objects of memory, recalling past triumphs or tragedies. They can be the last living witness to important events or community stories. Trees can also be objects of preservation, sometimes as individuals, other times as stands or even forests, all of which can take on historical significance for people, sites, and institutions. But as living entities they defy the kind of permanent legal preservation applicable to buildings and other non-living historical objects. Furthermore, their organic fragility can actually make them significant problems for historical sites and local preservation activities. For example, communities have had to cope with extensive tree loss from storm and fire damage, and dying trees can drop limbs or topple over, creating considerable danger to people and resources. Climate-change-driven increasing storm intensity has also highlighted the ways that trees--however historical or beloved--can become considerable threats. The fourteen new essays in this volume explore the many ways that trees are an integral part of public history practice and sites. The authors draw on a range of approaches and historiographies to look at how memories of race-based hate, patriotic stories, community identities, and changed places have all centered on trees. Analyzing provincial statutes and hundreds of criminal prosecutions, Kristin A. Olbertson argues that colonists transformed their understanding of speech offenses, from fundamentally ungodly to primarily impolite. As white male gentility emerged as the pre-eminent model of authority, records of criminal prosecution and punishment show a distinct cadre of politely pious men defining themselves largely in contrast to the vulgar, the impious, and the unmanly. "Law," as manifested in statutes as well as in local courts and communities, promoted and legitimized a particular, polite vision of the king's peace and helped effectuate the British Empire. Peyote Politics: The Making of the Native American Church, 1880-1937

Regarding peyote use among Native Americans, an ethnologist noted in 1891: "The ceremonial eating of the plant has become the great religious rite of all tribes of the southern plains." But, as Lisa D. Barnett observes in Peyote Politics: The Making of the Native American Church, 1880-1937, Peyotism quickly came under scrutiny, with opponents, both non-Native and Native, seeking to prohibit the religious practice by transforming peyote into a narcotic, thereby drawing Indigenous people into the emerging racialized campaign against drugs. A history of the rise of Peyotism and the Native American Church from the 1880s to the 1930s, Barnett's work details the ensuing struggle and its significance in reshaping Peyotists' identity as "Native" and "American" and establishing their place in the American political and legal systems. Barnett describes the strategies of resistance that Peyotists employed against opponents of their religious practice, including incorporating in 1918 as the Native American Church. In doing so, they secured their religious freedom but also formed a new, hybrid cultural sense of "Native American" that emphasized the reality of honoring both Native identity and American identity on the path to citizenship status. Placing the story of Peyotism within the broader historical context of federal Indian policy and Progressive Era politics, Peyote Politics shows how, despite their minority status in the American religious landscape, Peyotists were determined to secure constitutional protections for their religion and its rituals. Through their tireless efforts to protect their religion within the legal and political system, these Native Americans, many of whom were not yet American citizens, proved to be the true proponents of the constitutional idea of religious freedom.
